H-2A Visa — Agricultural visa program

For farms and agricultural businesses needing temporary seasonal workers. Workers typically come from Ukraine, Costa Rica, and Guatemala — they return home each season and come back to the same employer the following year.

New 2025–2026 wage system: DOL implemented a new two-tier skill-level wage system effective October 2, 2025. Wages are now state-specific at two levels (Level I entry / Level II experienced) based on BLS data, with a housing deduction for employers providing free housing. Rates update annually every July 1. Employer responsibilities under H-2A

Free housing

Provide housing with all utilities and daily transportation to/from worksite at no cost. Must meet federal, state, and local housing standards.

Transportation

Reimburse visa fees and travel (~$250) in week one. Reimburse inbound/outbound travel after 50% contract completion. Estimated airfare: $300–$1,300 round trip.

3/4 guarantee

Guarantee at least 75% of contracted hours. Example: 10 weeks × 48 hrs = 480 hrs × 75% = 360 hrs guaranteed minimum.

Wages

Pay at least the Adverse Effect Wage Rate (AEWR) for your state — now set at two skill levels. Must be the highest of: AEWR, prevailing wage, or state/federal minimum wage.

50% rule

Must offer jobs to any qualified US worker who applies during the first half of the contract. The government advertises on your behalf during this period.

Insurance

Provide workers' compensation coverage for all H-2A workers on your payroll.

H-2A workers are exempt from Medicare, Social Security, and Unemployment tax withholding — a significant cost savings for employers.
Visas issued for up to 10 months, extendable in one-year increments up to 3 years total. Work must be temporary, seasonal, or intermittent in nature.

Critical 2026 update: The H-2B statutory cap of 66,000 for FY2026 filled in both halves before deadlines. DHS added 64,716 supplemental visas but most are limited to returning workers (those who held H-2B status in FY2023, 2024, or 2025). Start your process early — waiting means missing the window entirely.

Allows a US citizen to bring their foreign fiancé(e) to the United States. Once here, the couple must marry within 90 days — after which the foreign spouse can apply for a green card.

Temporary Protected Status (TPS)

TPS protects nationals of designated countries from deportation and provides work authorization. Granted to people from countries experiencing armed conflict, natural disasters, or other extraordinary conditions.

H-4 Visa — Dependent visa for H-1B spouses & children

The H-4 visa allows the spouse and unmarried children (under 21) of H-1B or H-1B1 visa holders to live in the United States during the primary visa holder's authorized stay. In certain cases, H-4 holders may also apply for work authorization.

The B-1/B-2 visa allows foreign nationals to travel to the US temporarily — for business (B-1), tourism, vacation, or medical treatment (B-2), or a combination of both.

For attending business meetings, conferences, or negotiating contracts. Does not permit employment or receiving a US salary.

B-2 — Tourism & leisure

DS-160 & DS-260 — Consular Visa Application Assistance

Foreign nationals applying for a US visa through a US Embassy or Consulate abroad are required to complete either Form DS-160 or Form DS-260, depending on the visa category sought. iWorkMarket assists applicants with the accurate preparation and submission of these forms to ensure cases proceed without delays or requests for correction.

DS-160 — Nonimmigrant visa application

Required for all nonimmigrant (temporary) US visa applicants at a US Embassy or Consulate — including B-1/B-2, H-2A, H-2B, TN, K-1 fiancé(e), F-1 student, J-1 exchange visitor, and others. Submitted electronically through the State Department's Consular Electronic Application Center (CEAC). The barcode confirmation page must be presented at the consular interview.

DS-260 — Immigrant visa application

Required for immigrant visa (lawful permanent residence) applicants undergoing consular processing outside the US — including family-sponsored petitions, employment-based categories (EB-3), and Diversity Visa selections. Filed through CEAC following I-130 approval, once the National Visa Center (NVC) issues a welcome notice containing the case number and invoice ID.

Who needs the DS-160?

All nonimmigrant visa applicants at a US Embassy or Consulate abroad, including H-2A and H-2B workers, K-1 fiancé(e) petitioners, B-1/B-2 visitors, F-1 students, and TN professionals. Each applicant, including minor children, must submit a separate DS-160 form.

Who needs the DS-260?

All immigrant visa applicants undergoing consular processing outside the US, including spouses of US citizens or lawful permanent residents applying from abroad, EB-3 sponsored foreign workers, and Diversity Visa (DV lottery) selectees. The DS-260 application fee is $325, payable to the Department of State through the NVC/CEAC portal.

Why accuracy matters

Both forms are submitted under penalty of law. Form DS-160 cannot be amended after submission; the DS-260 requires NVC or consulate intervention to correct. Inaccuracies or omissions may result in visa denial or a finding of misrepresentation under INA §212(a)(6)(C)(i) — a bar with lasting immigration consequences. Accurate preparation from the outset is essential.

DS-160 is used through ceac.state.gov for nonimmigrant visas.  ·  DS-260 is filed through ceac.state.gov for immigrant visas. Both require an interview at a US embassy or consulate in your country.
